The recurring claim that undocumented immigrants get free health care

You're probably here because of the Sep 2025 rerun. This is the 10th time since 2016 (archive start) this story has run. The previous rerun was May 2025.

About this story

Since at least 2009, politicians and ads have repeatedly said that undocumented immigrants get free, taxpayer-funded health care. Attention peaks around Democratic positions (the 2019 debate hands, Harris in 2024), state programs in California and Illinois, and federal budget fights such as the 2025 shutdown. Federal law bars undocumented immigrants from Medicaid and ACA coverage except emergency care, while some states have paid for their own coverage.

Sep 2025 – ongoing 2025 government shutdown – "Democrats shut down the government for health care for illegal aliens"

On Sept. 28, 2025, Vice President Vance said on "Fox News Sunday" that Democrats were threatening a shutdown "because they want to give hundreds of billions of dollars of health care benefits to illegal aliens." PolitiFact reported that Trump and Speaker Johnson repeated the line, and NOTUS reported that Johnson and Senate Majority Leader Thune hammered it in "dozens" of press conferences and interviews. On Oct. 1 the White House published a release headlined "Democrats Shut Down Government Over Free Healthcare for Illegals." PolitiFact rated Vance's claim False and NPR called the GOP claim false. Both said people in the U.S. illegally were already barred from Medicaid and the ACA marketplaces. PolitiFact said the Democratic proposal would instead restore Medicaid and ACA access for lawfully present immigrants who stand to lose it under the 2025 tax-and-spending law.

May 2025 – Jul 2025 "One Big Beautiful Bill" debate

On May 16, 2025, the White House said the bill would protect Medicaid "by removing at least 1.4 million illegal immigrants from the program." On June 30, its "Myth vs. Fact" page said "over a million illegal aliens are receiving free health care on the backs of taxpayers." FactCheck.org noted that undocumented immigrants already can't get Medicaid except for emergency services, and Georgetown's Center for Children and Families noted that comprehensive Medicaid coverage isn't available to them. The 1.4 million figure came from a Congressional Budget Office (CBO) estimate of people who would lose coverage in programs paid for only by states. Under the House bill, states that used their own money to cover undocumented immigrants would have had their federal funding for the ACA Medicaid expansion cut from 90% to 80%. KFF says that penalty was left out of the final law.

Mar 2025 – Jun 2025 States cut back

California's health department told lawmakers in March 2025 that Medi-Cal had a $6.2 billion overrun. Part of the cause was that more immigrants without legal status enrolled than expected. The state estimated that covering them cost about $8.5 billion a year from the general fund (CalMatters). On May 14, 2025, Newsom proposed that, starting in 2026, Medi-Cal stop enrolling new adults 19 and older who lack legal status, and that some immigrant adults pay a $100 monthly premium starting in 2027. About 1.6 million were already enrolled and would keep coverage. Emergency and pregnancy care would stay covered (CalMatters, PolitiFact). In the same week, Trump and other Republican officials said the House bill would remove "millions" or "1.4 million" people in the country illegally from Medicaid. FactCheck.org found the claim false: people in the country illegally can't get federal Medicaid except for emergency services, and the 1.4 million figure from the Congressional Budget Office (CBO) referred to state-funded programs.

Jul 2024 – Nov 2024 Claims about Kamala Harris (2024)

After Harris became the presumptive nominee, Trump said at a July 24, 2024 rally that she "endorsed free taxpayer-funded government health care for all illegal aliens." The NRSC posted a similar claim, and PolitiFact said the Republican National Committee and others made similar assertions. PolitiFact rated Trump's claim Mostly False. It found that Harris raised her hand at the June 2019 debate when candidates were asked if their plans would cover people in the country illegally. However, she "has not expressly said she supports free, taxpayer-supported health coverage" for them. On current law, PolitiFact notes three points: Under EMTALA (1986), all patients get emergency-room treatment regardless of immigration status. Federal law generally bars states from using federal money to cover people in the country illegally. California's Medicaid expansion for immigrants regardless of status is paid for almost entirely with state money, according to the Public Policy Institute of California. In late October, Wisconsin Watch found no evidence for Vance's claim that Harris "promised to give Medicare to illegal aliens."

Dec 2023 – Jan 2024 California's Medi-Cal expansion to undocumented adults of all ages

On Jan. 1, 2024, California opened full-scope Medi-Cal to income-eligible undocumented immigrants of any age. The final step made adults aged 26–49 eligible: about 700,000 people according to state Sen. María Elena Durazo (ABC), or 764,000 expected enrollees at a cost of $2.9 billion in 2024–25 according to PPIC. PPIC says the program is "funded almost entirely with state dollars." CalMatters notes that the ACA bars people without legal status from federally subsidized insurance. Before this, undocumented adults could only get Medi-Cal for emergencies and pregnancy (ABC). Critics described the policy as taxpayer-funded care: a Jan. 4 release on the House Budget Committee website was headlined "Newsom Extends Free Healthcare to 700,000 Illegal Immigrants." State Senate Minority Leader Brian Jones told ABC that covering all undocumented immigrants would cost "over $6.5 billion annually," citing the Legislative Analyst's Office. In this rerun the claim had a real basis, but in a state-funded program, not a federal one.

Oct 2023 – Nov 2023 Illinois announces enrollment pause for Health Benefits for Immigrant Seniors program

Illinois's Health Benefits for Immigrant Seniors program began enrolling low-income undocumented people 65 and older on Dec. 1, 2020. It provides "Medicaid-like" coverage to people who would qualify for Medicaid except for their immigration status. That includes people in the U.S. without legal permission and green-card holders still in the five-year federal waiting period. Because federal reimbursement for noncitizens is limited, the program is paid for almost entirely with state money. On Oct. 19, 2023, HFS announced new senior enrollment would pause Nov. 6 at about 16,500 enrollees. A September 2023 HFS analysis projected the two programs together would cost $831 million in FY2024, more than $280 million over the $550 million lawmakers set aside.

Feb 2020 Trump's State of the Union attack on free health care for undocumented immigrants, and California's young-adult Medi-Cal expansion

In his Feb. 4, 2020 State of the Union, President Trump said that "over 130 legislators in this chamber" had backed legislation that would "bankrupt our nation by providing free taxpayer-funded health care to millions of illegal aliens." He added, "That is what is happening in California and other states." PolitiFact said the line seemed to refer to the Medicare for All bills from Sen. Bernie Sanders and Rep. Pramila Jayapal, which were meant to cover people regardless of immigration status. It rated the claim Half True, calling the "bankrupt" part "at best, a gross exaggeration." On Jan. 1, 2020, California opened full-scope Medi-Cal to income-eligible residents under 26 regardless of immigration status. The 2019-20 state budget set aside $98 million for the expansion, and about 90,000 undocumented young adults were expected to enroll. Before this, undocumented adults in this group could only get restricted-scope Medi-Cal, which mainly covers emergency services. Under federal law (EMTALA, 1986), hospitals must treat anyone who comes to an emergency room, whatever their ability to pay or citizenship (TIME). Peak attention: Feb. 4, 2020 (the speech) and Feb. 5 (PolitiFact and TIME fact-checks; 11alive recap the morning after).

Jul 2019 – Aug 2019 Trump campaign ad during Detroit Democratic debates claims Democrats support "free health care" for illegal immigrants

At the June 27, 2019 Democratic debate in Miami, moderator Savannah Guthrie asked the 10 candidates on stage to "raise your hand if your government plan would provide coverage for undocumented immigrants," and all of them did. A Trump re-election ad that aired during the July 30–31 debates used that clip with the narration "These Democrats support giving illegal immigrants free health care at our expense" (PolitiFact). PolitiFact rated the claim Mostly False. Its reasons: the question didn't ask whether the coverage would be free, and the two candidates who explained their answers didn't say it would be. Buttigieg said "This is not about a handout. This is an insurance program." A KFF brief from that July says undocumented immigrants could not enroll in Medicare, Medicaid or CHIP, or buy ACA Marketplace coverage. Federal law did require hospitals to screen and stabilize every patient seeking emergency care.

Jul 2019 California first to cover low-income undocumented young adults in Medi-Cal

On July 9, 2019, Gov. Gavin Newsom signed a law making low-income undocumented adults age 25 and younger eligible for Medi-Cal, California's version of Medicaid. AP and NPR called California the first state to offer such benefits to this group. State officials put the cost at $98 million, paid with state money. Medicaid is a joint state-federal program, but CapRadio reported the state would use its own funds for these benefits. NPR, citing the National Conference of State Legislatures, said people in the country illegally are generally not eligible for federal programs like Medicaid and Medicare, except in some cases such as emergencies and pregnancies. CapRadio said most undocumented Californians could get only "restricted" Medi-Cal, which covers emergencies and pregnancy care. NPR quoted Trump saying California's policy was "very unfair to our citizens." State Sen. Jeff Stone (R) said it would make California "a magnet." Peak attention was July 9–10, 2019: Newsom signed the bill on Tuesday, July 9; CapRadio and NPR (KPBS repost) published that day, and AP's story ran on CBS News on July 10.

Jun 2019 – Aug 2019 Democratic debate show of hands

At the June 27, 2019 debate, moderator Savannah Guthrie said, "Raise your hand if your government plan would provide coverage for undocumented immigrants," and all 10 candidates on stage raised their hands (PolitiFact; Democracy Now transcript; The Hill). The same night, President Trump tweeted: "All Democrats just raised their hands for giving millions of illegal aliens unlimited healthcare. How about taking care of American Citizens first!? That's the end of that race!" (NBC News). A July 2019 Trump campaign ad used the debate footage and said the candidates "support giving illegal immigrants free health care at our expense." PolitiFact rated that Mostly False because the question "did not ask if the coverage would be for free," and Buttigieg had described "an insurance program" people could "buy into." CNBC noted that the 2010 Affordable Care Act "largely excluded undocumented immigrants from buying into public programs."
